Advertisers Conditions
Advertisers confirm that their advertisements comply with all relevant laws or regulatory controls pertinent to their goods and services. Advertisers also confirm that their publication will not give rise to any claim against them by any third party. The advertiser will be liable to compensate us for all costs, losses, expenses and damages of any kind suffered or incurred by us as a result of claims or actions, arising from the advertisers breach of the website terms and conditions and/or the publication of their advertisement, unless caused by our own negligence. We have the right at all times to reject any advertisement which we consider may be inappropriate or contravene any legislation, guidelines, trading standards or standards of decency. We may do so without giving any reason. We shall not be liable if our publishing activities are restricted or prevented by any event beyond our control. In these cases the advertiser shall accept publication when possible or may cancel the order in writing paying only for work done. Should any advert not appear by reason of an omission on our part our liability shall be confined to republication at no charge. We expressly do not accept liability for any financial loss whatsoever resulting from non publication on behalf of any advertiser (business or private). We may cancel any account or order at any time if the advertiser breaches these website conditions or if we reasonably suspect their account or monies owed to us will not be settled. The location and positioning of advertising space on the site is at our sole discretion. Unless specifically ordered specified and paid for by the advertiser no positional rights are conferred.
Payment
All advertisements must be paid for in full at the time of booking unless credit has been agreed. The price shall be the amounts specified from time to time on our rates sheet plus VAT where applicable. For credit advertisers, we will cancel publication of any future advertisements if payment is not made in accordance with our payment terms and interest will be charged on late payments at the rate of 3% above the Bank of England’s base lending rate from the date payment is due together with the administration costs of collecting an overdue debt. By placing an order with us, an advertising agency confirms that it contracts as principal with full authority from its client in all matters connected with the order and is responsible for all payments due. We will only accept advertisements from advertising agencies if they are recognized by us. We will try to give notice of increases, but we reserve the right to change our advertising rates at any time. This will not affect contracts, including any fixed term agreement for a series of advertisements.
Refunds
If an advert does not comply with our terms and conditions of advertising we will withdraw it from the web site without warning and no refund will be made. We cannot accept and will reject adverts from advertisers who are under 18 years old.
Refunds after any advert has been processed and loaded on to the web site will be at our discretion and only made in exceptional circumstances. Any refunds given will be subject to an administrative charge of 10% of the cost price.
Links to Websites
We accept links to third part web sites. No web site link will be accepted or allowed if, in our sole opinion, it is in any way in competition with emlynfinder.co.uk. If an advertisers website or material is found to contain any element of competition at any stage after submission of their advert and/or link then we have a right to immediately withdraw their web site link without warning and no refund will be given. If we reject a web site link as an infringement of our terms and conditions prior to processing a full refund will be made. The web site address stated in the advert must be the web site address that the link points to, redirection of website links to a different website will not be accepted. Any adverts submitted with references to competitors of emlynfinder.co.uk in the description of the advert will have the advert removed without notification at our discretion.
